Terms and Shop Policies

These Terms and Shop Policies govern your use of blueridgebiodiversity.org and your interactions with Blue Ridge Biodiversity Conservancy, Inc. (“BRBC,” “we,” “us,” or “our”), including donations, memberships, customer accounts, and merchandise purchases.
By using this website or completing a transaction, you agree to these terms. Our Privacy Policy explains how we collect, use, and protect personal information.
General Website Terms
Information provided through this website, our publications, social media, emails, or educational materials is offered for general informational and educational purposes.
It is not a substitute for advice from a licensed wildlife rehabilitator, veterinarian, government wildlife agency, legal professional, tax professional, or other qualified expert. Wildlife conditions and legal requirements vary, and information may not apply to every situation.
Wildlife and Bird-Intake Disclaimer
BRBC is developing its native songbird rehabilitation facilities and securing the required permits, certifications, and operational capabilities. We are not currently accepting birds or other wildlife from the public.
Do not bring, mail, transport, or leave an animal at a BRBC location. Contacting BRBC, submitting a form, or sending photographs or information does not create an intake agreement or guarantee that BRBC can respond immediately or assume responsibility for an animal.
For an injured or orphaned wild animal, contact a currently licensed wildlife rehabilitator, veterinarian, animal-control agency, or appropriate state wildlife authority. If there is an immediate threat to human safety, contact the appropriate emergency authority.
Donations and Tax Deductibility
Blue Ridge Biodiversity Conservancy, Inc. is a North Carolina nonprofit organization recognized by the Internal Revenue Service as tax-exempt under Section 501(c)(3). EIN: 39-4749069.
Donations support BRBC’s current conservation and education work and the careful development of future rehabilitation capabilities. Contributions may be tax-deductible to the extent allowed by law. Individual tax circumstances vary, and donors should consult a qualified tax advisor.
A merchandise purchase is a commercial transaction and is not a charitable contribution. Whether any portion of a membership payment is deductible may depend on the value of benefits received and applicable law.
Donations are generally final. If you believe a donation was submitted in error or duplicated, contact us promptly at support@blueridgebiodiversity.org. Refund requests will be reviewed individually and remain subject to applicable law and payment-processing limitations.
Recurring Donations
When you select a recurring donation, you authorize BRBC and its payment processor to charge the payment method associated with your customer account at the frequency and amount shown during checkout. Charges continue until the recurring donation is canceled.
You may review or cancel a recurring donation by signing in to your customer account and selecting Recurring Donations. You may also request assistance by emailing support@blueridgebiodiversity.org.
Cancellation stops future scheduled donations but does not automatically refund donations already processed. Refunding an individual donation also does not automatically cancel future recurring donations. Please cancel before the next scheduled charge; a payment that has already entered processing may not be preventable.
Memberships and Automatic Renewal
Annual memberships renew automatically each year until canceled. By purchasing an automatically renewing membership, you authorize BRBC and its payment processor to charge the payment method associated with your customer account for each annual renewal.
Your membership details, renewal date, and available account-management options appear in your customer account. To prevent the next renewal, cancel your membership before its scheduled renewal date through your customer account or contact support@blueridgebiodiversity.org for assistance.
Cancellation stops future renewals. Unless otherwise stated or required by law, membership fees already paid—including completed renewal charges—are nonrefundable. Membership benefits continue through the end of the paid membership term unless the membership is terminated for misuse or another material violation of these terms.
Membership benefits, programs, and availability may change as BRBC’s work develops. We will not materially reduce a paid membership’s stated benefits during its current term without an appropriate remedy.
Customer Accounts
Squarespace customer accounts are used to manage recurring donations, memberships, saved payment methods, addresses, and eligible order information.
You are responsible for providing accurate information, maintaining the confidentiality of your login credentials, and promptly notifying us of suspected unauthorized account activity. Customer accounts are personal and may not be transferred or used to impersonate another person.
Payment-card information saved through a customer account is stored and processed by Squarespace Payments and its payment-processing partners. BRBC does not directly store complete payment-card numbers.
Merchandise Orders
Merchandise offered through our shop is sold by BRBC and fulfilled by Printful or another identified service provider. Merchandise purchases are not charitable contributions.
An order-confirmation email acknowledges that we received your order; it does not guarantee acceptance or fulfillment. We may cancel or decline an order because of suspected fraud, payment failure, pricing or listing errors, product unavailability, an undeliverable address, or another reasonable fulfillment issue. If we cancel a paid order, we will refund the affected amount.
Customers are responsible for reviewing product descriptions, size information, colors, quantities, personalization, and shipping addresses before submitting an order. Product images are representative. Colors, placement, scale, and appearance may vary slightly because of screen settings, garment construction, and the print-on-demand process.
Printful Fulfillment
Most physical merchandise is produced to order by Printful after a purchase is submitted. Printful receives the order and shipping information necessary to produce, package, and deliver the merchandise.
Because products are made on demand, production may begin shortly after an order is placed. Products from the same order may be produced at different facilities or arrive in separate packages.
BRBC remains the customer’s point of contact for shop questions and order problems. Please contact BRBC rather than returning an item directly to Printful.
Shipping Estimates and Tracking
Production and delivery dates shown at checkout or in order communications are estimates, not guaranteed arrival dates. Delivery may be affected by product availability, production volume, carrier operations, weather, customs, holidays, address problems, or other circumstances outside BRBC’s reasonable control.
When tracking is available, it will be sent with the shipping confirmation. Tracking information is supplied by the carrier and may take time to update, particularly when a package transfers between carriers.
If international shipping is offered, the recipient is responsible for applicable customs duties, import taxes, and local fees unless checkout expressly states otherwise.
If we learn that an order cannot be fulfilled within a reasonable period, we may contact you with available options or cancel the affected item and issue a refund.
Children’s Privacy
This website is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the website. A parent or guardian who believes a child has submitted personal information may contact us to request its deletion.
Incorrect, Damaged, or Defective Products
If you receive an incorrect, damaged, misprinted, or defective product, email support@blueridgebiodiversity.org within 30 days after receiving it.
Include:
Your name and order number
A description of the problem
Clear photographs showing the full product and the issue
Photographs of the packaging and shipping label when relevant
Do not mail the product to BRBC or Printful unless we provide return instructions.
When a manufacturing, printing, or fulfillment error is confirmed, we will arrange an appropriate replacement or refund at no additional charge. We may request additional information reasonably necessary to evaluate the claim.
Order Changes and Cancellations
Contact support@blueridgebiodiversity.org immediately if you need to change or cancel an order.
We can cancel or modify an order only if the request reaches us before Printful or another provider begins fulfillment. Because production may begin quickly, we cannot guarantee that a request can be completed.
Once fulfillment has started, product selections generally cannot be changed and the order generally cannot be canceled. Address changes may also become unavailable after processing or shipment begins.
Product Availability and Pricing
Products, colors, sizes, designs, and other variants may become temporarily unavailable or be discontinued without notice. A product’s appearance in the shop does not guarantee that it will remain available for fulfillment.
If an ordered item becomes unavailable, we may contact you about an alternative or cancel and refund the affected item. We will not substitute a materially different product without your approval.
We may correct pricing, product-description, or listing errors. If an error affects an order already submitted, we may contact you for approval of the corrected order or cancel and refund it.
Intellectual Property
Unless otherwise stated, the website’s text, photographs, graphics, logos, educational resources, merchandise designs, and other original content are owned by or licensed to BRBC and are protected by intellectual-property laws.
You may view and share links to our public content for personal, educational, and noncommercial purposes. You may not reproduce, modify, sell, distribute, remove attribution from, or commercially exploit our content without written permission, except as allowed by law.
The BRBC name, logo, and related branding may not be used in a way that suggests authorization, endorsement, partnership, or affiliation without written permission.

This website may link to wildlife resources, social networks, service providers, government agencies, or other third-party websites. Links are provided for convenience and information.
BRBC does not control and is not responsible for third-party content, availability, products, services, security, terms, or privacy practices. A link does not necessarily constitute an endorsement.
Disclaimer and Limitation of Liability
We make reasonable efforts to keep the website and its information accurate and available. However, the website and its content are provided on an “as available” basis. We do not guarantee that every page will be uninterrupted, error-free, complete, or current.
To the fullest extent permitted by law, BRBC and its directors, officers, volunteers, employees, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, reliance on educational content, or delay or interruption involving a third-party service.
For a claim arising directly from a merchandise order, BRBC’s total liability will not exceed the amount paid for the affected order, except where applicable law requires otherwise.
Nothing in these terms excludes or limits liability that cannot legally be excluded or limited.
Governing Law
These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
If any provision is found unenforceable, the remaining provisions will continue in effect.
Changes to These Terms
We may update these Terms and Shop Policies as our programs, website, memberships, shop operations, service providers, or legal obligations change. The effective date at the top of the page will identify the latest revision.
Changes apply prospectively after publication unless applicable law requires a different process. Terms that applied when a transaction was completed will continue to govern that transaction where appropriate.
